Rental Agreement
COMPLETE AND RETURN WITH COPY OF PHOTO ID.
Check-in: 4 p.m.
- Guests will receive check-in information, via email or text, 48-72 hours before arrival.
- Upon arrival, please inspect the unit thoroughly. Please report any issues to Beachy Keen Vacations immediately and we will do our best to resolve any problems in a timely manner.
- All requests for early check-in must be made PRIOR to arrival. Additional fees apply.
Check-out:10 a.m.
- To avoid additional charges, please abide by our check out time and procedures! Cleaners have limited time to prepare property for the next guests.
- If Guests stay past the check-out time and interfere with cleaners coming to prepare for the next guests, Guest will be billed for an additional day. This fee will be deducted from your security deposit.
- All requests for late check-out must be made PRIOR to arrival. Additional fees apply
Balance
Payment in full is required no less than thirty (30) calendar days prior to arrival date. Reservations made less than thirty (30) days prior to check-in require full payment. We accept cash, checks, credit and debit cards.
Guests booking with AirBnb are subject to AirBnb’s payment policy.
Confirmation Email
Confirmation emails will be sent 48-72 hours prior to arrival. Beachy Keen Vacations must have received payment in full, a copy of your photo ID, a signed rental agreement and completed occupancy page.
The email will include pertinent information on your rental including but not limited to: keyless entry access codes, parking information and amenity access.
Cancellation Policy
You have forty-eight (48) hours to cancel or change your reservation penalty free. After booking, your reservation is subject to our cancellation policy. Cancellations will be considered up to 30 days prior to arrival, for partial refund.
Reservations are non transferable, to another property or guest, without confirmation from Beachy Keen Vacations.
Linens
Bath towels and bed linens are provided with the cleaning fee. However, please remember to bring your own beach towels, toiletries, paper products and specialty items.
Housekeeping
Each property should contain a vacuum, broom, mop, and basic cleaning products. Toiletries are not provided. Departure cleaning service is required for all rentals and is not included in the rental rate for the unit.
Preparing for Departure:
- Remove all personal belongings
- Place all towels on the bathroom floor/s.
- Load and start dishwasher and/or wash any dirty dishes
- Lock all doors and windows
- Return any keys, parking passes, fobs, bands, etc to the unit
- Remove trash and place in outside containers
Parking
Parking procedures vary by property and can be found in your Confirmation Email. Parking procedures must be strictly adhered to. Your vehicle will be towed, and you will be responsible for all charges, fees, and fines if parking procedures are violated. Management is not responsible for parking rules, violations, fines, or towing of vehicles.
General Rules
Violation will result in your loss of the rental unit and ejectment without refund of deposits and any paid fees.
- A responsible adult, over the age of 25, must be always present.
- All occupants agree to act in a manner that permits neighbors peaceful enjoyment of their properties. Noise Ordinance in effect from 11:00 p.m.-7:00 a.m.
- NO Smoking in unit or on balconies/decks
- NO House Parties-no more occupants are allowed on the property than listed in the property description.
- NO unaccompanied Minors
- NO Fireworks
- NO illegal activities or substances
- No grilling on balconies, decks or porches
- No connecting to the utilities of the property
- No placement or hanging of items on balconies, decks or porches (includes towels and swimsuits)
- No sitting on rails or banisters of balconies, decks or porches
- No removal of any items from the property except your personal belongings
- All local ordinances and Homeowners Association Rules and Regulations must be strictly adhered to
Non-Smoking Property
Smoking, of any kind, is strictly prohibited inside the vacation rental and on decks and balconies. This includes, but is not limited to cigarettes, cigars, pipes, vaping devices, e-cigarettes and drugs. Smoking will result in additional charges and eviction. In signing, Guest agrees to a minimum $250 charge to Guest if evidence of smoking is discovered.
Pet Policy
- Pets are not permitted unless your rental is labeled as a “pet friendly” property.
- A Pet Addendum must be completed and approved for all pets. If an unauthorized pet is discovered, there will be a $350.00 fee and the guests in the property will be asked to vacate the premises with no refund.
- “Visiting” Pets are not permitted and will be deemed as an unauthorized pet.
- Only well-mannered, house-trained dogs are allowed in our pet friendly units.
- Pet Addendum, up-to-date vaccination records and pet fee must be received 7 days prior to arrival.
Furnishings, Appliances, Fixtures, Equipment and Household Items
- Units are individually owned, decorated, and furnished at the owner’s discretion and may change without notice.
- The rearranging of furniture in or on the Property is strictly prohibited and will result in additional charges. Loss to these items, as well as damage to the Property or its furnishings more than normal wear and tear will be charged to the credit card on file. Guest is expected to leave property and contents in their original conditions and positions upon departure.
- Sleeper sofas are NOT intended for adult use for sleeping.
- All electrical, plumbing and appliances should be in working order. If you experience a problem during your stay, please call Beachy Keen Vacations immediately and we will make every effort to resolve the issue in a timely manner.
- The failure of operation of certain extra amenities, such as TVs, cable, games, AC, WIFI service, etc are NOT a basis for refunds.
Emergency Access, Property Maintenance, Repairs & Right to Inspect
Guests(s) grant Beachy Keen Vacations and/or its representatives to enter the property during the hours of 8 am to 8 pm to assess or complete repairs, or to grant access for a showing (if the property is currently listed for sale).
Routine pest control is performed on units. Contact Beachy Keen Vacations immediately if you experience a pest issue. No refunds will be given for pest issues.
If a tenant refuses entry to a representative of or on behalf of Beachy Keen Vacations the tenant will be responsible for the charges for the service call and any additional damages that have occurred due to the refusal of entry.
In the event of an emergency, notice of entry is not required by Beachy Keen Vacations and/or it’s representatives. Beachy Keen Vacations and its agents reserve the right to enter and inspect the rental unit without prior notice to enforce the terms of this agreement.
Locked Areas/Owner Closets
Areas for which Guest is not provided a key, such as Owner closets or storage areas, are exempt from this Agreement and are off limits to Guest. Forced entry into these locked areas is cause for immediate eviction and Guest will be charged for damage and/or missing items.
Internet Connection/Television
Most properties offer an internet connection and cable or streaming device as a courtesy. Cable and internet at the applicable properties is a courtesy of the owner to the guests and is not included in the rental rate. No refunds will be given for loss of use.
Surveillance
Exteriors of buildings or properties may be subject to security footage and monitoring.
Email and/or Text Messaging
You agree to be contacted by Beachy Keen Vacations by booking a reservation, providing a cellular telephone number and/or email address.
Assumption of Risk
No lifeguard may be on duty. Accordingly, persons using the beach or pool do so at their own risk and the owner assumes no responsibility for accident or injury. No one should swim alone. Renters will hold the Owners and Beachy Keen Vacations harmless from any and all bodily injury and/or property damage incurred on the property arising out of Renters’ negligent acts or omissions.
Guests understand that no special efforts have been made to “childproof” this vacation rental and accept the risk of harm to any children allowed on the property. These risks are not limited to, but include access to the ocean, pool, adjacent street, cleaning supplies in the house and plants in the house, patio and on the street, that might be poisonous if ingested.
Beach Conditions
Guest understands that Owner and Beachy Keen Vacations have no control over the condition of the beach and cannot be held liable for any changes to the beach conditions or closings as ordered by an official agency.
Hurricane/Weather Evacuation
(South Carolina Vacation Rental Act SECTION 27-50-260) If state or local authorities order a mandatory evacuation of an area that includes a residential property subject to a vacation rental, the tenant in possession of the property shall comply with the evacuation order. No refunds will be issued for mandatory evacuations or loss of use due to “Acts of God”. There are NO REFUNDS for hurricanes, tropical storms, or weather conditions. Tenants and occupants assume the risk.
Property Unable to be Occupied
In the event that a property cannot be occupied due to unpredictable events, removal of property from rental program, or sale of property; management will contact the guest immediately. Management will make every effort to transfer the reservation to a comparable property (if available) or the guest will be entitled to a full refund. Guests agree to pay any difference in rental rates and not hold the homeowner or manager liable for any, consequential damages.
Communities and Resort Properties
Beachy Keen Vacations is an independent property management company, retained by the individual owner of the property/unit and is not affiliated with any on-site management company or homeowners’ association. Beachy Keen Vacations does not warrant, guarantee, or endorse any services offered by third party companies. On-site amenities, common areas, and property equipment are maintained by the HOA.
Rental Agent/Owner Liability
Guests(s) agree not to hold Beachy Keen Vacations and the Property Owner liable for any damage, loss or injury to persons or property occurring on or about the rental unit or common grounds. All occupants agree to hold Beachy Keen Vacations, its representatives, and the property owner harmless in the event of any loss, injury, or damage. In the event public servants including but not limited to law enforcement, ambulance, fire fighters, are requested, Guest(s) shall pay any fine issued, against themselves, the property owner, and Beachy Keen Vacations.
Legal Fees:
If any legal action or proceeding (including default, non-payments, etc.) arises out of or related to this Rental Agreement is brought by either party to this Rental Agreement, the prevailing party shall be entitled to receive from the other party, in addition to all other relief that may be granted, the reasonable attorney’s fees, costs and expenses incurred in the action or proceeding by the prevailing party.
Remedies
In the event of a default to the Rental Agreement, particularly, but not limited to Guests unauthorized “holding over” or those acts mentioned above in this agreement, and in addition to all other rights and remedies Owner or Beachy Keen Vacations may have by law, Owner or Beachy Keen Vacations shall have the option, without written notice or as the Law may hereinafter provide, Owner or Beachy Keen Vacations may immediately re-enter and remove all persons and property from premises. In such an instance, the Rental Agreement will be terminated, and no refunds shall be issued. Guests of the property waive any right to written notice for entry to the Owner or Beachy Keen Vacations.
Owner shall be entitled to otherwise recover all damages allowable under the Law. The Guest, as part of the considerations of this special rental, in recognition that this property is booked in advance by other Guests throughout the year, hereby waives all claims for damages that might be caused by Owner, Beachy Keen Vacations and/or its staff or representatives; re-entry and taking possession of premises or removing or storing property as herein provided, and will hold Owner and Beachy Keen Vacations harmless from loss, costs and damages occasioned thereof, and no such re-entry shall be considered or construed to be a forcible entry or other similar statutory provisions. Further, if for any reason Owner or Beachy Keen Vacations is unable to deliver possession of the premises to Guest at the commencement of the term specified in the Rental Agreement, Beachy Keen Vacations shall refund amounts paid by Guest, but shall not be liable for any other damages caused thereby.
Indemnification
The Guest agrees to indemnify and hold harmless the Owner and Beachy Keen Vacations for any damages to or loss from the rental property, grounds, furnishings, appliances, household items and any other of the Owner’s property resulting during the Guest’s rental term, normal wear and tear excluded. The Guest further agrees to indemnify and hold the owner harmless from any claim or liability for any loss or damage whatsoever arising from, related to or in connection with the rental of this Rental Property, including but not limited to any claim for personal injury or damage or loss of property which is made, incurred, or sustained by the Guest or other occupants or invitees of Guest. The owner is not responsible for any of the Guest’s or other occupant(s) valuables, cash or other property during the rental term or thereafter left at the rental house
Release of Liability
The Owner and Beachy Keen Vacations will not be held responsible for accidents or injury to Guest, any members of their party or any invitees to the Property or for the loss of money or valuables. Guest is expressly responsible for the safety of him/herself and any members of their party and any invitees to the Property. In using or permitting to be used the Property and the recreational or other facilities associated with or a part of the Property, Renter and Renter’s party specifically waive any and all liability claim, expressed or implied, against Owner and/or Beachy Keen Vacations.
